Purpose

BigOcasion was created out of the need for a tool to boost sales of online and/or physical stores on the internet, using marketplaces in a simple way. Our intention is to eliminate obstacles related to documentation and bureaucratic requirements and help our clients have the best experience in online commerce.

This document is intended to ensure that BigOcasion respects the privacy of our clients and all individuals who choose to share their information with us through our website. We are committed to protecting your Personal Data and privacy.

When you contract BigOcasion’s services, you provide us with your Personal Data so that we can enable the provision of Our services and deliver the best possible experience.

If you do not accept or agree with this Privacy Policy, you will not be able to use the services provided by BigOcasion, as they depend on the use of the data you provide for the operation of the Platform and other services, including your Personal Data.

This Policy applies to any processing of Personal Data carried out by BigOcasion, in accordance with the Terms of Use of each product, under the following conditions:

  • BigOcasion Clients: natural persons who effectively contract, use, or access one or more services or products of BigOcasion representing a legal entity, legally or de facto;

  • BigOcasion Prospects: natural persons prospectively contacted by Us or who have requested contracting our services but have not yet become clients;

  • Consumers purchasing products from BigOcasion: natural persons who have purchased physical products from BigOcasion.

What is personal data

“Personal Data” means information relating to an identified or identifiable natural person, according to the terms established by the General Data Protection Law. The Personal Data we collect and process are used to offer and improve Our services or to enable the establishment and maintenance of Our relationship with you.

Acceptance of this privacy policy

This document is an integral part of the Terms of Use of all BigOcasion services. Therefore, once acceptance of the Terms of Use of the product(s) contracted has been obtained, this Policy also applies, and consent is given for the collection and use of information and Personal Data as part of the contractual purpose.

If you are reading this Privacy Policy on behalf of a legal entity, you acknowledge the provisions herein on behalf of that entity and declare that you have the legal capacity, full power, and authority to bind that entity.

If you do not accept or agree with this Privacy Policy, you will not be able to use the services provided by BigOcasion, as their use depends on the data you provide for the operation of the Platform(s) and other services, including your Personal Data.

What personal data and information are processed by BigOcasion

As provided in the various Terms of Use of BigOcasion, in order to register and use the Platforms and services offered by BigOcasion, the User must initially provide some of the following commercial or Personal Data:

Information about individuals:

  • Full name;

  • Phone/mobile number;

  • Email address;

  • Residential address;

  • Tax Identification Number (NIF);

  • Gender;

  • Date of birth;

  • Digitized copy of personal document and data contained therein, including, if necessary, analysis of official photograph.

Information about legal entities:

  • Company Tax Identification Number (NIF);

  • Phone/mobile number;

  • Email address;

  • Business address;

  • Bank details;

  • Business license;

  • User profile creation;

Some of the commercial data provided by the User may be considered Personal Data, which may be processed by BigOcasion as necessary for the correct use and operation of the Platform(s) and other services provided by BigOcasion and/or for the purposes specified in this Policy.

BigOcasion also obtains publicly accessible Personal Data through its partners for market research and knowledge purposes. Regarding potential clients, BigOcasion may collect some data such as name, email, phone, and company to update Our contact list to offer our services.

Furthermore, BigOcasion may collect publicly available information about clients or information made public by them, such as testimonials and comments posted on social media profiles and pages, including names and images (profile photos).

We process Personal Data of research and campaign participants and social media Users to conduct studies and surveys, ensuring anonymization whenever possible. In these cases, we may collect name, age, phone number, and socioeconomic data, always requesting the participant’s consent.

During events promoted by BigOcasion, we may collect Personal Data from participants and speakers, such as name, email, phone, identification document, employer, and position, to send invitations and for internal control and security purposes.

Data collected during use of services

In addition to data provided by the User during registration, use, and termination of BigOcasion’s services and Platform, log data from your computer and/or smartphone may also be stored, collected, deleted, processed, reproduced, transferred, and used. Such log data may include, but is not limited to, your computer and/or smartphone IP address, device name, operating system version, site and/or app settings when using the service, date and time of use, and other statistics, in accordance with the Cookies Policy.

All such log data aims to improve the services and Platform provided by BigOcasion and to identify possible failures or improvements in these systems.

User profile creation

We are committed to providing you with more and better services. To this end, we create profiles by evaluating some personal aspects such as your usage history on the Platform, behaviors, or interests through automatic processing of Personal Data using statistical procedures. With the result of this processing, we can assist you better and more efficiently.

Final considerations

We may also process your Personal Data to comply with legal or regulatory obligations; exercise rights in judicial, administrative, or arbitration proceedings; based on legitimate interests; and to execute contracts.

5.1. Use of Cookies

The use of BigOcasion services and the Platform also generates "Cookies" files (and other similar technologies such as web beacons), and the rules for the use, collection, and processing of these Cookies apply.

All browsing and device data collected or provided by the User or third parties to BigOcasion, as well as any logs stored, deleted, processed, reproduced, transferred, and used by the Group, will be intended to improve the services and the Platform provided by Us, as well as to identify any faults or improvements in these systems. Such data may be collected through cookies and other similar technologies like web beacons.

BigOcasion does not explicitly process these “cookies.” However, the Platform may use third-party codes and libraries that use cookies to obtain information, improve its services, and display advertisements.

You always have the option to accept or refuse these “cookies” and to know when a “cookie” is being sent to your computer and/or smartphone. If you choose to refuse cookies, the service and the Platform may not work properly.

What is the minimum age to access the Platform and services provided by BigOcasion?

Our services and Platform are intended only for access and use by individuals with full legal capacity, i.e., persons over 18 (eighteen) years of age. By accessing or using the services and the Platform, you guarantee and declare that you have full legal capacity, that is, you are of legal age, and therefore fully able to understand, accept, and comply with this Privacy Policy and the Terms of Use of BigOcasion’s products and services.

If you do not have or consider yourself not to have full legal capacity, access to and use of Our Services and the Platform will be prohibited.

If it is detected by any means that personal data of a minor under eighteen (18) years of age is being processed, BigOcasion will delete all records. Purpose of processing your personal data

All processing of commercial data or Personal Data under the law, by and on behalf of BigOcasion, is for the following purposes:

  • Registration and identification of the User on the services and the Platform, as well as their use;

  • Communication between BigOcasion and the User regarding services provided by BigOcasion and the Platform, as well as information, advice, newsletters, marketing or promotional materials;

  • Communication and identification of visitors who are potential Users of the Services and Platform;

  • Analyze performance, facilitate, and enable the provision of services and the Platform, as well as their Users;

  • Communication and resolution of agreements with third-party service providers, who may provide Personal Data from their databases for the proper use and execution of the Platform and other services provided by BigOcasion; and

  • Verification of data accuracy and fraud prevention, aiming to protect rights and property of all kinds, as well as the integrity and security of BigOcasion, its services, and the Platform, through audits and/or integrity checks carried out by BigOcasion or third parties on its behalf, in accordance with the Terms of Use of each product you contracted.

Commercial information and Personal Data processed by BigOcasion are not shared with third parties, except in cases expressly provided in the Terms of Use of each product and this Privacy Policy, for the proper use and execution of the Platform and services provided by BigOcasion.

BigOcasion allows Users limited access to certain data (such as name, address, or tax identification number) of Consumers for: (a) transaction-related purposes on the Platform; (b) use of services offered by BigOcasion (such as billing, shipping, transport, and complaints about fraud or services); and (c) any other purpose with the User’s express consent after prior notice.

Personal Data or commercial information processed by Users of the services and Platform, due to their use and execution, may not be processed beyond what is provided in this Privacy Policy and the Terms of Use of each product contracted. Violating Users are subject to the sanctions set forth in the applicable Terms of Use, in addition to those provided under administrative, civil, and criminal laws.

BigOcasion does not control, store, or have access to messages and content sent by Users through means other than the Platform and therefore assumes no responsibility for any damages that may result from their use. Negotiations carried out by Users through such means are the Users’ responsibility.

BigOcasion is not responsible for business or transaction information published or circulated on the Platforms. Users agree that BigOcasion will not be liable for losses or damages resulting from transactions conducted or failed between Users and/or consumers. Consequently, the client releases BigOcasion from all liability in case of conflicts with one or more Users.

Services provided by BigOcasion, as well as its Platform, may contain links to third-party websites to ensure their proper use and execution. If you click on a third-party link, you will be directed to that site. Note that these external sites are not operated by BigOcasion. Therefore, BigOcasion strongly recommends reviewing the privacy policies of these third-party websites. We have no control and assume no responsibility for the content, Terms of Use, privacy policies, or practices of any third-party services or websites.

With whom do we share your personal data?

We may share Personal Data with third parties and agencies within the BigOcasion Group when necessary for the provision of Our services and execution of Our institutional purposes, as indicated below:

  • Service providers contracted to act on behalf of BigOcasion to provide a service following Our instructions, to help improve or facilitate operations through Our services;

  • Business partners with whom BigOcasion maintains collaboration or alliance relationships;

  • BigOcasion Users to enable Our services;

  • Administrative and judicial authorities who, in exercising their competence, require information;

  • Among companies of the BIGgroup – to which BigOcasion belongs – to support and promote their activities, especially to offer services according to the User’s profile, provided the purposes and other rules established in this Privacy Policy and the Terms of Use of each product are observed; and

  • BigOcasion employees and suppliers to enable Our services.

BigOcasion only shares relevant, proportional, and non-excessive data concerning the purpose of sharing.

If BigOcasion needs to share Your Personal Data with third parties other than those mentioned above, we will update this Policy.

International transfer of personal data

The services provided by BigOcasion require support from technological infrastructure that may be located outside Spain, such as servers and cloud services, which may be owned or provided by third parties.

Security of your personal data

BigOcasion values your trust in providing us with your information, including some Personal Data, and therefore adopts acceptable administrative and technical measures to protect them from unauthorized processing, as well as accidental or unlawful situations. However, it is important to emphasize that no method of internet transmission or electronic storage is 100% secure and reliable.

BigOcasion will not be liable under any circumstances for any damages of any kind, including but not limited to disclosure of Personal Data and User access by third parties or loss of such information resulting directly or indirectly from misuse of the Platform by the User.

Personal Data provided by the User to BigOcasion is encrypted, and access logs (date, application usage time, and IP address) are archived for at least 6 (six) months, with your access made exclusively for the purpose of providing BigOcasion’s Services.

The User agrees to keep confidential the contact email and password provided for accessing BigOcasion’s services and Platforms, as well as to provide truthful information to Us.

The User agrees to immediately notify BigOcasion of the loss, theft, or robbery of their access credentials or any risk of third-party use; BigOcasion is not responsible for misuse of the data.

Duration of processing

According to the BigOcasion Terms of Use, the provision of services and the use of the Platforms have an indefinite duration; therefore, as long as the User maintains a relationship with BigOcasion, their information will continue to be processed.

While Your relationship with BigOcasion is maintained, Your Personal Data will continue to be used and processed by Us. However, even after Your relationship with BigOcasion ends for any reason, Your Personal Data will be retained by Us and/or authorized third parties for the period necessary to:

  • Comply with a legal or regulatory obligation of BigOcasion and its suppliers or business partners;

  • Exercise rights in judicial, administrative, or arbitration proceedings;

  • Guarantee fraud prevention and security for the User and BigOcasion; and/or

  • Protect BigOcasion’s credit.

Furthermore, BigOcasion may retain Your Personal Data for other purposes provided by law, such as exclusive use by BigOcasion in anonymized form or in situations justifying Our legitimate interest.

Your rights

BigOcasion respects your privacy and provides the necessary channels to exercise Your rights and receive adequate, clear, and transparent information about the use and processing of Your Personal Data.

Requests to correct incomplete, inaccurate, or outdated data and/or delete data provided to BigOcasion by the User, including Personal Data, must be made by sending a message in the "Contact Us" section. Such requests will be analyzed and, unless they imply service interruption or fall under data retention exceptions specified above, will be processed.

If the request implies service interruption, Your relationship with BigOcasion will be terminated, but obligations arising from service provision, such as payments due to BigOcasion and/or its partners, will remain valid, and Your information and Personal Data will continue to be processed by Us and/or authorized third parties until the need or purpose ends.

In addition to correction and deletion, You may also exercise the following rights:

  • Confirm the processing of Your Personal Data by BigOcasion and/or authorized third parties, and access it, even after the termination of Your relationship with BigOcasion as provided in Chapter 11 of this Policy;

  • Receive information about public and private entities with which the controller has shared data;

  • Be informed about the possibility of withholding consent and the consequences of refusal when BigOcasion requests Your consent for specific Personal Data processing;

  • Withdraw consent for Personal Data processing when applicable and be informed of the consequences of such action in specific situations; and

  • Inform BigOcasion if You disagree with the processing of Your Personal Data, explaining the reasons so that We can review the situation.

BigOcasion will anonymize, block, or delete any Personal Data that becomes unnecessary or excessive and will not process such Data inconsistently with the General Data Protection Law.

BigOcasion reserves the right to change this Privacy Policy at its discretion at any time without prior notice to the User. Any changes will be published on BigOcasion’s platforms.

The User should periodically check this Privacy Policy to stay informed of modifications. Continued use of your BigOcasion account constitutes acceptance of the changes and the new Privacy Policy.

BigOcasion will notify the User through the Platforms and/or email when the Privacy Policy changes. Upon becoming aware of the changes, you may request clarifications from BigOcasion regarding any modifications to Your Data processing. Additionally, due to changes in Our Policy, you may be asked to confirm your consent when applicable. You are always responsible for updating your Personal Data.

Applicable law and competent jurisdiction

The applicable law in case of dispute or conflict of interpretation of the terms composing this legal notice, as well as any matters related to the services of this Electronic Headquarters, shall be Spanish law.

For the resolution of any conflict arising during the visit to the Electronic Headquarters of the Tax Agency or the use of its services, the Tax Agency and the user agree to submit to the courts and tribunals located in Spanish territory.
